Terms of Use Agreement: Rules & Policies for bumblefuck Users

Welcome to bumblefuck ("Platform," "we," "us," or "our"). By accessing or using our website located at bumblefuckk.com (the "Site") or any related applications, services, or features (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). The "bumblefuck" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of bumblefuck or its affiliates or licensors. You must not use such marks without the prior written permission of bumblefuck.

You retain ownership of any content you submit, post, or display on or through the Services ("Your Content"). By submitting Your Content, you grant bumblefuck a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform Your Content in connection with the Services.

To the fullest extent permitted by applicable law, in no event shall bumblefuck, its affiliates, licensors, service providers, employees, agents, officers, or directors be liable for any indirect, special, incidental, consequential, or punitive damages, including but not limited to damages for loss of profits, loss of data, business interruption, or personal injury, arising out of or in connection with your use, or inability to use, the Services, any websites linked to it, any content on the site or such other websites, or these Terms.

Our total cumulative liability to you for all claims arising from or related to the Services or these Terms shall not exceed the greater of (a) the amount you have paid to bumblefuck in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).

This limitation of liability applies regardless of the legal theory on which the claim is based, including contract, tort, negligence, strict liability, or any other basis, even if bumblefuck has been advised of the possibility of such damages.

YOUR USE OF THE SERVICES AND THEIR CONTENT IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER bumblefuck NOR ANY PERSON ASSOCIATED WITH bumblefuck MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES.

TO THE FULLEST EXTENT PROVIDED BY LAW, bumblefuck HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

The foregoing does not affect any warranties that cannot be excluded or limited under applicable law. We do not guarantee that the Services will be uninterrupted, secure, or error-free, or that any defects will be corrected.

We may suspend or terminate your access to and use of the Services, at our sole discretion, at any time and without notice to you, for any reason, including if we believe you have violated these Terms.

You may terminate your account at any time by contacting us or using the account deletion tools within the Services. Upon any termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the federal courts of the United States or the courts of the State of Delaware, in each case located in the City of Wilmington and County of New Castle. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the Services.

The "Last Updated" date at the top of these Terms will indicate when the latest revisions were made.
